Public Liability Compensation

A wide variety of circumstances in which people sustain injuries can be defined as "public liability claims".

These include claims for people who are injured on premises owned or occupied by someone else, for example a guest at a holiday resort who falls through a rotten timber step. Claims involving people who are injured whilst attending an event may also have a public liability claim not only against the owner or occupier of the premises but the promoter of the event.

We will advise you regarding the process involved in making a claim including time limits regarding the submission of any necessary claim forms and pursuing a common law claim.

Turner Freeman Lawyers will advise you about the benefit to you of a claim and also advise you with respect to the issue of liability (or who is responsible for causing your injury).

If you decide to pursue a claim, Turner Freeman Lawyers will prepare the Notice of Accident Claim Form and submit the document to the relevant compulsory third party insurer.

Once all relevant information has been collected, a settlement conference will be organised. We will advise you about what we think is a reasonable range of outcomes for the settlement of your claim, so that you can make an informed decision about any offers made to you at the conference.

Only if your claim is not resolved at the settlement conference will the court then become involved. A Claim and Statement of Claim will be filed in the court. Turner Freeman Lawyers will advise you as your claim advances through the steps required to be undertaken in order to progress your claim to trial. Of course the great majority of claims settle by negotiation before a trial is necessary.
